About these Terms
These Terms of Service ("Terms") govern your use of launchmvpfast.com (the "Site") and any services provided through it (the "Services"). Launch MVP Fast is a brand and website owned and operated by Upsilon LLC (referred to in these Terms as "we", "us", or "our").
By using the Site or Services, you agree to these Terms. If you do not agree, please do not use the Site.
Who can use the Site
You must be at least 18 years old to use the Site or request services. By using the Site, you confirm that you meet this requirement.
If you are using the Site on behalf of a company or other legal entity, you confirm that you have authority to bind that entity to these Terms.
The services we provide
Launch MVP Fast provides:
- A web-based estimate tool that generates indicative scope, timeline, and price ranges for MVP development projects.
- MVP development services (design, build, and launch of software products).
- Post-MVP services (additional features, maintenance, technical support).
- Educational content (blog articles, guides) provided free of charge.
The estimate tool and Site are free to use. Paid services are governed by a separate written agreement (Statement of Work or similar) between you and Launch MVP Fast.
Estimates are not quotes
Estimates produced by our estimate tool are indicative ranges based on the information you provide. They are not binding quotes or offers to perform work at a specific price.
A binding price requires:
- A scoping conversation with our team.
- A written proposal or Statement of Work.
- Your explicit acceptance of that proposal.
Estimates may differ from the final quoted price once we have understood the full scope of your project.
Your information and confidentiality
When you submit an idea through our estimate tool or communicate with us, we collect and store that information as described in our Privacy Policy.
We treat customer ideas and project information as confidential by default. We do not share, publish, or use your idea descriptions for any purpose other than providing services to you. If you would like a formal Non-Disclosure Agreement (NDA) signed before sharing details, contact [email protected] and we will provide one.
You can request deletion of your data at any time. See our Privacy Policy for the deletion process and timelines.
Intellectual property
Our Site and content
The Site, including text, graphics, logos, software, and design, is owned by Launch MVP Fast or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site without our written permission, except as permitted for normal browsing and printing for personal use.
Your content
You retain ownership of any content you submit to us (idea descriptions, project specifications, materials shared during engagements). By submitting content, you grant us a limited, non-exclusive license to use it solely for the purpose of providing the Services to you.
Work product from paid engagements
For paid MVP development engagements, ownership of code, designs, and other deliverables is governed by the Statement of Work or written agreement between you and Launch MVP Fast. By default, customers own 100% of the work product upon full payment, unless otherwise agreed.
Acceptable use
You agree not to:
- Use the Site or Services for any unlawful purpose.
- Submit content that is illegal, infringing, defamatory, or harmful.
- Attempt to reverse engineer, scrape, or exploit the estimate tool or any part of the Site.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Interfere with the operation of the Site or its underlying infrastructure.
We reserve the right to suspend or terminate access for users who violate these terms.
Disclaimers
Site provided "as is"
The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or completely secure.
Estimates are indicative
Estimates produced by the estimate tool are not guarantees of price, scope, or feasibility. Final pricing requires a written agreement.
Third-party content and links
The Site may link to third-party websites or services. We are not responsible for the content, privacy practices, or terms of those third parties.
Limitation of liability
To the maximum extent permitted by law, Launch MVP Fast and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including but not limited to lost profits, lost data, or business interruption.
Our total liability arising from or related to the Site (separate from paid engagements governed by their own agreements) will not exceed $100 or the amount you have paid us in the past 12 months, whichever is greater.
Some jurisdictions do not allow exclusion of certain warranties or limitation of liability — in those jurisdictions, our liability is limited to the maximum extent permitted by law.
Paid services and engagements
Paid services (MVP development, post-MVP engagements, technical support, etc.) are governed by a separate written agreement between you and Launch MVP Fast. That agreement controls in case of any conflict with these Terms.
These Terms apply to the use of the Site and to free interactions with the estimate tool and our team. They do not replace your engagement contract.
Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms.
You may stop using the Site at any time. You can request deletion of your data per our Privacy Policy.
Termination of access to the Site does not affect any ongoing paid engagement, which is governed by its separate agreement.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top and, where appropriate, notify you. Continued use of the Site after changes constitutes acceptance of the updated Terms.
Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles.
Any disputes arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those courts.
For EU/UK customers: nothing in this section limits your right to bring legal proceedings in the courts of your country of residence, where required by applicable consumer protection law.
Miscellaneous
- Entire agreement: These Terms (together with the Privacy Policy and any signed engagement agreement) constitute the entire agreement between you and Launch MVP Fast regarding the Site.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force.
- Waiver: Failure to enforce any provision of these Terms is not a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights without restriction.
